Nitekim bu y\u00fck\u00fcml\u00fcl\u00fckler, Almanya d\u0131\u015f\u0131nda faaliyet g\u00f6steren t\u00fcm tedarik\u00e7ileri de yak\u0131ndan etkileyecektir.<\/p>\n<p>Bunlar\u0131 be\u015f ana ba\u015fl\u0131kta toplayabiliriz:<\/p>\n<ul>\n<li>Risk de\u011ferlendirmesi yapma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc<\/li>\n<li>Durum tespiti y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn yerine getirildi\u011fine ili\u015fkin raporlama yap\u0131lmas\u0131<\/li>\n<li>Rehber ilkelerin haz\u0131rlanmas\u0131<\/li>\n<li>Etki de\u011ferlendirmesi<\/li>\n<li>Korunan insan haklar\u0131 de\u011ferleri<\/li>\n<\/ul>\n<h4>1.R\u0130SK DE\u011eERLEND\u0130RMES\u0130<\/h4>\n<p>Yasa\u2019n\u0131n Alman \u015firketlerden beklentisi, \u015firketlerin b\u00fcy\u00fckl\u00fc\u011f\u00fc, faaliyet alanlar\u0131 ve tedarik zincirindeki konumlar\u0131yla orant\u0131l\u0131 olarak kendi tedarik zincirleri i\u00e7indeki insan haklar\u0131 ihlali risklerini tespit etmeleri ve raporlamalar\u0131d\u0131r. Bu amaca ula\u015fmak i\u00e7in \u015firketler, insan haklar\u0131, istihdam ko\u015fullar\u0131 ve \u00e7evre konular\u0131 ile ilgili durum tespiti yapmak durumundad\u0131r. Bu y\u00fck\u00fcml\u00fcl\u00fck, risk analizi yapmak, \u00f6nleyici ve ihlali giderici tedbirler almak, ilgili dok\u00fcmantasyon ve raporlamalar\u0131 yapmay\u0131 kapsamaktad\u0131r. Bu y\u00fck\u00fcml\u00fcl\u00fcklere, insan haklar\u0131 komiseri atamak, bir politika metni haz\u0131rlamak ve bir \u015fikayet mekanizmas\u0131 kurmak da dahildir.<\/p>\n<h4>2.DURUM TESP\u0130T\u0130 Y\u00dcK\u00dcML\u00dcL\u00dc\u011e\u00dcN\u00dcN YER\u0130NE GET\u0130R\u0130LD\u0130\u011e\u0130NE \u0130L\u0130\u015eK\u0130N RAPORLAMA YAPILMASI<\/h4>\n<p>Alman \u015firketler bir \u00f6nceki finansal y\u0131la ili\u015fkin durum tespiti y\u00fck\u00fcml\u00fcl\u00fcklerini yerine getirdiklerine dair y\u0131ll\u0131k birrapor haz\u0131rlayacakt\u0131r. Bu raporda a\u00e7\u0131k\u00e7a:<\/p>\n<p>\u015eirketin hangi riskleri tespit etti\u011fi<br \/>\nDurum tespit y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc yerine getirirken politika metninde yazan hususlar dahil hangi tedbirlerin al\u0131nd\u0131\u011f\u0131<br \/>\n\u015eirketin tedbirlerin etkisi ve etkinli\u011fi hakk\u0131ndaki de\u011ferlendirmesi ve,<br \/>\nGelecekteki tedbirlerin de\u011ferlendirilmesi yer alacakt\u0131r.<\/p>\n<h4>3.YASA\u2019YA AYKIRILI\u011eIN YAPTIRIMI<\/h4>\n<p>Yasa\u2019da yer alan y\u00fck\u00fcml\u00fcl\u00fcklere ayk\u0131r\u0131l\u0131k halinde Alman \u015firketleri 100,000 Avro\u2019 dan 800,000 Avro\u2019 ya kadar de\u011fi\u015fen para cezalar\u0131 beklemektedir. Bununla birlikte y\u0131ll\u0131k cirosu 400 milyon Avro ve fazla olan \u015firketlerin de ortalama y\u0131ll\u0131k cirolar\u0131n\u0131n %2\u2032 si oran\u0131nda para cezas\u0131na \u00e7arpt\u0131r\u0131lmas\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Ayr\u0131ca \u015firketler Yasa\u2019y\u0131 ihlal etmeleri halinde \u00fc\u00e7 y\u0131ll\u0131\u011f\u0131na tedarik, in\u015faat veya hizmet alanlar\u0131nda kamu ihalelerine kat\u0131lmaktan men edilebilecektir.<\/p>\n<h4>4.REHBER \u0130LKELER<\/h4>\n<p>Yasa\u2019n\u0131n nas\u0131l uygulanaca\u011f\u0131 belli \u00f6l\u00e7\u00fcde a\u00e7\u0131k olmamakla birlikte; yasa tasar\u0131s\u0131nda OECD (Ekonomik Kalk\u0131nma ve \u0130\u015fbirli\u011fi \u00d6rg\u00fct\u00fc) Ticari \u0130li\u015fkilerde Durum Tespiti Rehberi ile UN OHCHR (Birle\u015fmi\u015f Milletler \u0130nsan Haklar\u0131 Y\u00fcksek Komiserli\u011fi) \u0130nsan Haklar\u0131 Kurumsal Sorumlulu\u011fu Hakk\u0131nda Rehber\u2019ine at\u0131f yap\u0131lm\u0131\u015f olup bu rehberler, Yasa\u2019n\u0131n arzu etti\u011fi durum tespiti y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn i\u00e7eri\u011finin ve uygulamas\u0131n\u0131n nas\u0131l olu\u015fturulaca\u011f\u0131na ili\u015fkin \u00f6nemli metinler olarak de\u011ferlendirilmektedir. Buna g\u00f6re ticarette insan haklar\u0131 ihlalleri a\u015fa\u011f\u0131da yer alan 3 farkl\u0131 \u015fekilde ger\u00e7ekle\u015febilir:<\/p>\n<ul>\n<li>\u015eirket kendi ticari operasyonlar\u0131 s\u0131ras\u0131nda insan haklar\u0131n\u0131 ihlal edebilir<\/li>\n<li>Kendi ticari operasyonlar\u0131 sebebiyle do\u011frudan yada bir ki\u015fi (h\u00fck\u00fcmet, di\u011fer bir \u015firket, vb.) arac\u0131l\u0131\u011f\u0131 ile ihlale katk\u0131da bulabilir.<\/li>\n<li>Bir ki\u015finin fiilleri sebebiyle ortaya \u00e7\u0131kan ihale bu ki\u015fi ile ticari ili\u015fkisi oldu\u011fu i\u00e7in dahil olmu\u015f olabilir. Dolay\u0131s\u0131yla \u015firketlerin \u00f6zellikle bu \u00fc\u00e7 gruptaki risk alanlar\u0131na dikkat etmesi beklenecektir.<\/li>\n<\/ul>\n<p>\u201c\u0130nsan haklar\u0131na y\u00f6nelik kurumsal sorumluluk\u201d kapsam\u0131nda bahsedilen insan haklar\u0131, \u00f6ncelikle \u0130nsan Haklar\u0131 Bildirgesi(Evrensel \u0130nsan Haklar\u0131 Bildirgesi ve Uluslararas\u0131 Ekonomik, Sosyal ve K\u00fclt\u00fcrel Haklar S\u00f6zle\u015fmesi ile Uluslararas\u0131 Medeni ve Siyasi Haklar S\u00f6zle\u015fmesi dahil) ve Uluslararas\u0131 \u00c7al\u0131\u015fma \u00d6rg\u00fct\u00fc\u2019n\u00fcn \u0130\u015fyerinde uygulanacak Temel Prensipler ve Haklara ili\u015fkin bildirgede yer verilen insan haklar\u0131d\u0131r.<\/p>\n<p>Tedarik zincirinin sonraki basamaklar\u0131 i\u00e7in yap\u0131lmas\u0131 gereken bu risk de\u011ferlendirmesi i\u00e7in \u015firketler, ilk basamaktedarik\u00e7ilerinden kendi risk de\u011ferlendirmelerini yapmalar\u0131n\u0131 ve bu ilk basamak tedarik\u00e7ilerin de kendi tedarik\u00e7ileri i\u00e7inayn\u0131 risk de\u011ferlendirmesini yapmalar\u0131n\u0131 isteyebilecektir. Bu risk de\u011ferlendirmesi kapsamda \u015firketler, s\u00f6zle\u015fmesel bir ili\u015fki i\u00e7inde ya da s\u00f6zle\u015fme akdetme a\u015famas\u0131nda olduklar\u0131 tedarik\u00e7ilere kar\u015f\u0131 \u00f6zellikle a\u015fa\u011f\u0131daki \u00f6nleyici \u00f6nlemleriuygulayacaklard\u0131r:<\/p>\n<ul>\n<li>Tedarik\u00e7i se\u00e7iminde insan haklar\u0131 konusunda beklentiler g\u00f6z \u00f6n\u00fcnde bulundurulacakt\u0131r.<\/li>\n<li>Tedarik\u00e7ilerden kendi i\u015f sahalar\u0131 ve tedarik zincirlerindeki insan haklar\u0131 ihlal risklerini tespit etmeleri<\/li>\n<li>\u0130nsan haklar\u0131n\u0131n g\u00f6zetilmesini sa\u011flamak amac\u0131yla ortaya konulan beklentilerin yerine getirilip getirilmedi\u011fini denetlemek i\u00e7in s\u00f6zle\u015fmesel kontrol mekanizmas\u0131 kurulacak ve s\u00f6z konusu beklentilerin yerine getirilmesi i\u00e7in gerekli olan e\u011fitimlerin verilmesi sa\u011flanacakt\u0131r.<\/li>\n<li>Do\u011frudan tedarik\u00e7ilerin insan haklar\u0131 stratejilerine uygunlu\u011funu denetleyen risk odakl\u0131 kontrol mekanizmas\u0131 kurulmas\u0131 sa\u011flanacakt\u0131r.<\/li>\n<\/ul>\n<h4>5. KORUNAN \u0130NSAN HAKLARI DE\u011eERLER\u0130<\/h4>\n<p>Yasa kapsam\u0131nda korunan insan haklar\u0131 ba\u015fl\u0131ca \u015fu \u015fekildedir: ya\u015fam hakk\u0131, sa\u011fl\u0131k hakk\u0131, adil ve elveri\u015fli \u00e7al\u0131\u015fma ko\u015fullar\u0131ndan yararlanma hakk\u0131, insan onuruna yak\u0131\u015f\u0131r bir hayat s\u00fcrme hakk\u0131, \u00e7ocuk haklar\u0131, k\u00f6lelik ve esarete tabi tutulmama hakk\u0131, zorla veya zorunlu \u00e7al\u0131\u015fmaya tabii tutulmama hakk\u0131, dernek kurma ve toplu pazarl\u0131k hakk\u0131, i\u015fkence ve k\u00f6t\u00fc muameleye tabi tutulmama hakk\u0131, insanl\u0131k d\u0131\u015f\u0131 ve a\u015fa\u011f\u0131lay\u0131c\u0131 muameleye tabi tutulmama hakk\u0131\u2026<\/p>\n<p>Alman Tedarik Zinciri Yasas\u0131 uyar\u0131nca T\u00fcrk \u015firketlerinin almas\u0131 gereken \u00f6nlemler:<\/p>\n<p>Yasa uyar\u0131nca tedarik zinciri, bir \u015firketin t\u00fcm \u00fcr\u00fcn ve hizmetlerinin dahil oldu\u011fu s\u00fcre\u00e7leri kapsamaktad\u0131r. Dolays\u0131yla tedarik zinciri, hammaddenin \u00e7\u0131kar\u0131lmas\u0131ndan son \u00fcr\u00fcn\u00fcn nihai m\u00fc\u015fteriye teslimine kadar \u00fcr\u00fcnlerin imalat\u0131 ve hizmetlerin sa\u011flanmas\u0131 i\u00e7in gerekli olan yurt i\u00e7i ve yurt d\u0131\u015f\u0131nda y\u00fcr\u00fct\u00fclen t\u00fcm ad\u0131mlar\u0131 kapsamaktad\u0131r.<\/p>\n<p>Bu sebeple bir T\u00fcrk \u015firketi Alman bir \u015firketin do\u011frudan tedarik\u00e7isi olabilir. Yasa\u2019ya g\u00f6re do\u011frudan tedarik\u00e7i; \u015firketin \u00fcr\u00fcn\u00fcn\u00fcn imalat\u0131 veya ilgili hizmetin sa\u011flanmas\u0131 ve bu hizmetten faydalan\u0131lmas\u0131 i\u00e7in tedariki gereken mallar\u0131n teslimiveya hizmetlerin sa\u011flanmas\u0131na ili\u015fkin kurulan bir s\u00f6zle\u015fmenin tarafi olan ki\u015fidir.<\/p>\n<p>Bununla birlikte yine bir T\u00fcrk \u015firketi Alman bir \u015firket a\u00e7\u0131s\u0131ndan ara tedarik\u00e7i konumunda da olabilir. Yasa\u2019ya g\u00f6re ara tedarik\u00e7i, do\u011frudan tedarik\u00e7i olmayan ve \u015firketin \u00fcr\u00fcn\u00fcn\u00fcn imalat\u0131 veya ilgili hizmetin sa\u011flanmas\u0131 ve bu hizmetten faydalan\u0131lmas\u0131 i\u00e7in tedarik faaliyetine ihtiya\u00e7 duyulan \u015firket olarak tan\u0131mlanmaktad\u0131r.<\/p>\n<p>Yasa ayr\u0131ca, denetim y\u00fck\u00fcml\u00fcl\u00fcklerinden ka\u00e7\u0131nmak amac\u0131yla, do\u011frudan tedarik\u00e7inin ara tedarik\u00e7i olarak g\u00f6sterildi\u011fi hallerde, ara tedarik\u00e7i olarak g\u00f6sterilen tedarik\u00e7inin do\u011frudan tedarik\u00e7i olarak kabul edilece\u011fini d\u00fczenlemi\u015ftir.<\/p>\n<p>LkSG a\u00e7\u0131s\u0131ndan do\u011frudan tedarik\u00e7i ile ara tedarik\u00e7i aras\u0131ndaki fark, Alman \u015firketlerinin uygulayaca\u011f\u0131 denetimde kendini g\u00f6stermektedir. Buna g\u00f6re, Alman \u015firketler do\u011frudan tedarik\u00e7ilerine kar\u015f\u0131 risk analizi yapmakla, s\u00f6zle\u015fmesel mekanizmalarla uygun \u00f6nleyici ve iyile\u015ftirici tedbirler almakla y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n<h5>T\u00fcrk \u015eirketlerinin Y\u00fck\u00fcml\u00fcl\u00fckleri:<\/h5>\n<p>\u0130\u015f Kanunu uyar\u0131nca \u00e7ocuk i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 ko\u015fullar\u0131na riayet edilmesi, a\u015f\u0131r\u0131 ekonomik veya cinsel s\u00f6m\u00fcr\u00fc ve a\u015fa\u011f\u0131lanma yoluyla k\u00f6lelik ve k\u00f6leli\u011fe benzer veya tahakk\u00fcm veya bask\u0131n\u0131n uygulanmamas\u0131, i\u015fyeri ve i\u015f ekipmanlar\u0131n\u0131n sa\u011flanmas\u0131, kimyasal, fiziksel veya biyolojik maddelerden korunmak i\u00e7in \u00f6nlemlerin al\u0131nmas\u0131, \u00e7al\u0131\u015fma saatleri ve dinlenme aralar\u0131 a\u00e7\u0131s\u0131ndan uygun olmayan i\u015f organizasyonu nedeniyle a\u015f\u0131r\u0131 derecede fiziksel ve zihinselyorgunlu\u011fu \u00f6nleyici \u00f6nlemlerin al\u0131nmas\u0131, \u00e7al\u0131\u015fanlara gerekli e\u011fitimlerin verilmesi, i\u015f\u00e7ilerin sendikal kurma ve \u00fcye olma haklar\u0131n\u0131 kullanmalar\u0131n\u0131 engellememe, i\u015f\u00e7ilerin sendikal haklar\u0131 kullanmalar\u0131n\u0131n ayr\u0131mc\u0131l\u0131k ve haks\u0131z uygulama yaratmamas\u0131n\u0131n sa\u011flanmas\u0131, grev ve toplu pazarl\u0131k haklar\u0131n\u0131n kullan\u0131lmas\u0131n\u0131 sa\u011flama, ki\u015filerin etnik k\u00f6ken, sosyal k\u00f6ken, sa\u011fl\u0131k durumu, cinsel y\u00f6nelim, cinsiyet, ya\u015f, siyasi g\u00f6r\u00fc\u015f, din veya d\u00fcnya g\u00f6r\u00fc\u015f\u00fc gibi sebeplerle istihdamda e\u015fit olmayan muamelede bulunmama, e\u015fit de\u011ferdeki i\u015f\u00e7i i\u00e7in e\u015fit \u00fccret verilmesi, i\u015f\u00e7ilere en az y\u00fcr\u00fcrl\u00fckteki asgari \u00fccretinverilerek adil(makul) \u00fccret verilmesini sa\u011flama, topra\u011f\u0131n tahrip edilmesini, suyun ve havan\u0131n kirlenmesini \u00f6nleme, hava emisyonuna veya a\u015f\u0131r\u0131 su t\u00fcketimine yol a\u00e7mama, c\u0131vaya ili\u015fkin Mimata S\u00f6zle\u015fmesi\u2019ne uygun hareket edilmesi,kal\u0131c\u0131 Organik Kirleticilere \u0130li\u015fkin Stockholm S\u00f6zle\u015fmesi\u2019ne uygun hareket edilmesi, tehlikeli at\u0131klara ili\u015fkin Basel S\u00f6zle\u015fmesine uygun hareket etmek olarak \u00f6zetlenebilir.<\/p>\n<h5>YAPILMASI GEREKENLER<\/h5>\n<p>Alman \u015firketler do\u011frudan tedarik\u00e7ilerini se\u00e7erken ve onlarla ticaret yaparken \u00f6zellikle a\u015fa\u011f\u0131daki hususlaradikkat edecektir;<\/p>\n<p>\u0130nsan haklar\u0131 ve \u00e7evreye ili\u015fkin beklentilerini kar\u015f\u0131lay\u0131p kar\u015f\u0131lamad\u0131klar\u0131na bakacakt\u0131r.<br \/>\n\u015eirket y\u00f6netiminin gerektirdi\u011fi insan haklar\u0131na y\u00f6nelik ve \u00e7evresel beklentilere uyacaklar\u0131na ve bu beklentileritedarik zinciri boyunca kar\u015f\u0131layacaklar\u0131na ili\u015fkin s\u00f6zle\u015fmesel g\u00fcvence<br \/>\nDo\u011frudan tedarik\u00e7ilerin bir \u00f6nceki maddede bahsedilen g\u00fcvencelerini yerine getirmeleri i\u00e7in e\u011fitimler<br \/>\nKendi insan haklar\u0131 stratejilerine uygunlu\u011fu kontrol etmek
