Bu makalede, bu \u00fclkelerin t\u00fcketici haklar\u0131, veri koruma, lisans gereklilikleri ve di\u011fer ilgili konular kapsam\u0131ndaki d\u00fczenlemelerini AB ve TR mevzuat\u0131 ile kar\u015f\u0131la\u015ft\u0131rmal\u0131 olarak inceleyece\u011fiz.<\/p>\n<p>\u00dcLKELERE G\u00d6RE E-TICARET D\u00dcZENLEMELERI<br \/>\nSUUD\u0130 ARAB\u0130STAN<\/p>\n<p>Suudi Arabistan&#8217;da E-Ticaret Kanunu 10 Temmuz 2019 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe girmi\u015ftir.[1] E-Ticaret Kanunu, e-ticaretin Suudi Arabistan ekonomisine katk\u0131s\u0131n\u0131 art\u0131rmay\u0131, yabanc\u0131 ve yerel e-ticaret \u015firketlerinin Suudi Arabistan&#8217;da yat\u0131r\u0131m yapmalar\u0131n\u0131 sa\u011flamay\u0131 ve 2030 Vizyonu&#8217;na ula\u015f\u0131lmas\u0131n\u0131 sa\u011flamay\u0131 ama\u00e7lamaktad\u0131r. Kanun, Suudi Arabistan&#8217;da bulunan Hizmet Sa\u011flay\u0131c\u0131lar ile Suudi Arabistan d\u0131\u015f\u0131nda bulunan ancak Suudi Arabistan&#8217;daki t\u00fcketicilere \u00fcr\u00fcn veya hizmet sa\u011flayan Hizmet Sa\u011flay\u0131c\u0131lar\u0131n hak ve y\u00fck\u00fcml\u00fcl\u00fcklerini d\u00fczenlemektedir. Hizmet Sa\u011flay\u0131c\u0131lar; ticaret siciline kay\u0131tl\u0131 e-ticaret uygulay\u0131c\u0131lar\u0131 (Tacirler) ve ticaret siciline kay\u0131tl\u0131 olmayan e-ticaret uygulay\u0131c\u0131lar\u0131 (Uygulay\u0131c\u0131lar) olarak tan\u0131mlanm\u0131\u015ft\u0131r. Ancak, kay\u0131tl\u0131 olmayan hizmet sa\u011flay\u0131c\u0131lar\u0131n (Uygulay\u0131c\u0131lar) e-ticaret sitelerinde \u015firket adreslerini belirtmeleri gerekmektedir.<\/p>\n<p>T\u00fcketici Haklar\u0131<\/p>\n<p>Hizmet Sa\u011flay\u0131c\u0131lar; t\u00fcketici verilerinin korunmas\u0131na (md.5), mal\/hizmet \u00f6zelliklerinin uygun ve do\u011fru bir \u015fekilde a\u00e7\u0131klanmas\u0131na, akdedilecek s\u00f6zle\u015fmenin h\u00fck\u00fcm ve ko\u015fullar\u0131n\u0131 i\u00e7eren bir beyan\u0131n t\u00fcketiciye sunulmas\u0131na (md.7), belirtilen teslim tarihi ve yerini, vergiler d\u00e2hil toplam fiyat\u0131 ve varsa teslimat masraflar\u0131n\u0131 g\u00f6steren ayr\u0131nt\u0131l\u0131 bir fatura sunulmas\u0131na dikkat etmekle y\u00fck\u00fcml\u00fcd\u00fcr. (md.8).<\/p>\n<p>E-Ticaret Kanunu, t\u00fcketicinin e-ticaret i\u015flemlerine ili\u015fkin g\u00fcvenini art\u0131rmay\u0131 hedefleyerek, t\u00fcketiciyi doland\u0131r\u0131c\u0131l\u0131k, aldatma ve yan\u0131lt\u0131c\u0131 bilgi beyanlar\u0131na kar\u015f\u0131 korumay\u0131 ama\u00e7lamaktad\u0131r.<\/p>\n<p>Hizmet Sa\u011flay\u0131c\u0131lar, E-Ticaret Kanunu ve Y\u00f6netmeli\u011fi h\u00fck\u00fcmlerine uymad\u0131klar\u0131 takdirde yakla\u015f\u0131k 270.000 dolar ceza \u00f6demektedirler.<\/p>\n<p>Hizmet Sa\u011flay\u0131c\u0131lar, E-Ticaret Kanunu ve Y\u00f6netmeli\u011fi uyar\u0131nca yap\u0131lan s\u00f6zle\u015fmenin h\u00fck\u00fcm ve ko\u015fullar\u0131n\u0131 sa\u011flamak zorundad\u0131r. Mal\/hizmetlerin temel \u00f6zellikleri, \u00fcr\u00fcn garanti bilgileri, \u00fcr\u00fcn ve\/veya hizmetin vergiler d\u00e2hil toplam fiyat\u0131, varsa teslimat ve nakliye masraflar\u0131, \u00f6deme ve teslimat ko\u015fullar\u0131, hizmet sa\u011flay\u0131c\u0131n\u0131n ileti\u015fim bilgileri, ad\u0131, ikametg\u00e2h adresi vb. bilgiler ile her bir i\u015flemin niteli\u011fine g\u00f6re Hizmet Sa\u011flay\u0131c\u0131n\u0131n vermesi gereken bilgileri d\u00fczenleyen Y\u00f6netmeliklerde belirtilen di\u011fer \u00f6zel bilgilerin T\u00fcketiciye a\u00e7\u0131klanmas\u0131 gerekmektedir. E-Ticaret Kanunu h\u00fck\u00fcmleri sakl\u0131 kalmak kayd\u0131yla, T\u00fcrk ve AB mevzuat\u0131 uyar\u0131nca hizmet sa\u011flay\u0131c\u0131n\u0131n \u00f6n bilgilendirme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc kapsam\u0131nda, \u00f6demenin onaylanmas\u0131n\u0131n ard\u0131ndan taraflar aras\u0131nda ba\u011flay\u0131c\u0131 bir s\u00f6zle\u015fme akdedilece\u011fi ve bu s\u00f6zle\u015fmenin bir \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc te\u015fkil edece\u011fi hususunda t\u00fcketicinin a\u00e7\u0131k\u00e7a bilgilendirilmesi gerekmektedir. (Y\u00f6netmelik Madde 7.)<\/p>\n<p>E-Ticaret Kanunu uyar\u0131nca t\u00fcketiciye, E-Ticaret Kanunu&#8217;nda belirtilen haller d\u0131\u015f\u0131nda mal veya hizmeti kullanmam\u0131\u015f ya da yarar sa\u011flamam\u0131\u015f olmas\u0131 durumunda, teslim ald\u0131\u011f\u0131 tarihten itibaren yedi (7) g\u00fcn i\u00e7inde bir e-ticaret kanal\u0131yla sat\u0131n ald\u0131\u011f\u0131 \u00fcr\u00fcn\u00fc iade etme veya hizmet s\u00f6zle\u015fmesini feshetme hakk\u0131 tan\u0131nm\u0131\u015f ve s\u00f6zle\u015fmeyi feshetme masraf\u0131 t\u00fcketiciye verilmi\u015ftir. T\u00fcrk mevzuat\u0131nda oldu\u011fu gibi t\u00fcketicinin iade ve iptal hakk\u0131 nedeniyle cayma hakk\u0131 vard\u0131r, ancak T\u00fcrkiye&#8217;de iade hakk\u0131 14 g\u00fcn olarak tan\u0131nm\u0131\u015ft\u0131r ve t\u00fcketicinin s\u00f6zle\u015fmeyi feshetmesi durumunda herhangi bir maliyet olu\u015fmamaktad\u0131r.<\/p>\n<p>T\u00fcketicinin s\u00f6zle\u015fmeyi feshetme hakk\u0131na ek olarak, Hizmet Sa\u011flay\u0131c\u0131n\u0131n teslimat\u0131 on be\u015f g\u00fcnden fazla geciktirmesi halinde de t\u00fcketici sipari\u015fini iptal etme hakk\u0131na sahip olacakt\u0131r.<\/p>\n<p>E-Ticaret Kanunu&#8217;nun 11. maddesinde yer alan cayma hakk\u0131n\u0131n kullan\u0131lamayaca\u011f\u0131 haller Mesafeli S\u00f6zle\u015fmeler Y\u00f6netmeli\u011fi&#8217;nin 15. maddesi ile ayn\u0131d\u0131r.<\/p>\n<p>E-Ticaret Sitelerinde A\u00e7\u0131klanmas\u0131 Gereken Bilgiler<\/p>\n<p>Kanun ve Y\u00f6netmeli\u011fin 6. maddesi uyar\u0131nca Hizmet Sa\u011flay\u0131c\u0131 bu bilgileri internet sitesinde a\u00e7\u0131klamak zorundad\u0131r: Hizmet sa\u011flay\u0131c\u0131n\u0131n bir E-ma\u011faza Kimlik Do\u011frulama Otoritesine kay\u0131tl\u0131 olmamas\u0131 halinde hizmet sa\u011flay\u0131c\u0131n\u0131n ad\u0131 ve hizmet sa\u011flay\u0131c\u0131y\u0131 tan\u0131t\u0131c\u0131 her t\u00fcrl\u00fc \u00f6zelli\u011fi; \u015firketin sicile kay\u0131tl\u0131 olmas\u0131 halinde ad\u0131 ve sicil numaras\u0131, e-ticaret sitesi gizlilik politikas\u0131 (T\u00fcrkiye&#8217;deki mevzuata ayk\u0131r\u0131 olarak gizlilik politikas\u0131n\u0131n bir zorunluluk olmad\u0131\u011f\u0131n\u0131n belirtilmesi halinde), kullan\u0131m ko\u015fullar\u0131, varsa hizmet sa\u011flay\u0131c\u0131n\u0131n lisans bilgileri ve ileti\u015fim numaras\u0131, hizmet sa\u011flay\u0131c\u0131n\u0131n vergi numaras\u0131, m\u00fc\u015fteri \u015fikayetleri ve \u00e7\u00f6z\u00fcm usul ve y\u00f6ntemleri.<\/p>\n<p>Kay\u0131t<\/p>\n<p>Y\u00f6netmeli\u011fin 12. Maddesi uyar\u0131nca e-ma\u011faza kurulduktan sonra 30 g\u00fcn i\u00e7erisinde ticaret siciline tescil edilmesi gerekmektedir. Ticaret siciline kay\u0131tl\u0131 olmayan uygulay\u0131c\u0131lar, Y\u00f6netmeli\u011fin 12. Maddesinde istenen bilgileri toplayarak Bakanl\u0131\u011f\u0131n internet sitesi \u00fczerinden ba\u015fvuruda bulunabilirler. Tamamen yabanc\u0131 bir giri\u015fim i\u00e7in, Yat\u0131r\u0131mc\u0131 Lisans\u0131 i\u00e7in Suudi Arabistan Yat\u0131r\u0131m Otoritesine ba\u015fvuru yap\u0131lmal\u0131d\u0131r. Yat\u0131r\u0131mc\u0131 lisans\u0131 ile yabanc\u0131 yat\u0131r\u0131mc\u0131, yerel bir i\u015f orta\u011f\u0131na ihtiya\u00e7 duymadan \u015firketini b\u00f6lgede i\u015fletebilir. Yat\u0131r\u0131mc\u0131 lisans\u0131na ek olarak, yabanc\u0131 yat\u0131r\u0131mc\u0131lar Ticaret ve Sanayi Bakanl\u0131\u011f\u0131&#8217;na ticaret sicil belgesi i\u00e7in ba\u015fvurmal\u0131d\u0131r. Ticaret ve Sanayi Odas\u0131na kay\u0131t olmak ve Genel M\u00fcd\u00fcr ile g\u00f6r\u00fc\u015fmek zorunludur. Ayr\u0131ca, yabanc\u0131 yat\u0131r\u0131mc\u0131n\u0131n Zekat, Vergi ve G\u00fcmr\u00fck \u0130daresi, \u0130nsan Kaynaklar\u0131 ve Sosyal Kalk\u0131nma Bakanl\u0131\u011f\u0131 ve Sosyal Sigortalar Genel Kurulu\u015flar\u0131na kay\u0131t yapt\u0131rmas\u0131 zorunludur. [2]<\/p>\n<p>Elektronik Reklamlar<\/p>\n<p>E-Ticaret Kanunu uyar\u0131nca ticari reklamlar s\u00f6zle\u015fmenin ayr\u0131lmaz bir par\u00e7as\u0131d\u0131r ve yasal olarak ba\u011flay\u0131c\u0131d\u0131r. Hizmet Sa\u011flay\u0131c\u0131, reklamda belirtilen \u00fcr\u00fcn \u00f6zellikleri ve fiyat\u0131 ile ba\u011flay\u0131c\u0131 olacakt\u0131r. E-Ticaret Kanunu uyar\u0131nca elektronik reklamlar\u0131n i\u00e7eri\u011finde; reklam\u0131 yap\u0131lan \u00fcr\u00fcn veya hizmetin ad\u0131, bir e-ma\u011faza kimlik do\u011frulama kurulu\u015funa kay\u0131tl\u0131 de\u011filse Hizmet Sa\u011flay\u0131c\u0131n\u0131n ad\u0131 ve her t\u00fcrl\u00fc tan\u0131t\u0131c\u0131 \u00f6zelli\u011fi, Hizmet Sa\u011flay\u0131c\u0131n\u0131n ileti\u015fim bilgileri ve Y\u00f6netmelikte belirtilen di\u011fer bilgiler yer almal\u0131d\u0131r. Hizmet sa\u011flay\u0131c\u0131 elektronik iletilerinin i\u00e7eri\u011finde; reklam oldu\u011funa dair a\u00e7\u0131k ve anla\u015f\u0131l\u0131r bir ifade kullanmal\u0131 ve reklam\u0131 yap\u0131lan \u00fcr\u00fcn\/hizmetin \u00f6zellikleri hakk\u0131nda do\u011fru bilgi vererek t\u00fcketicinin bilin\u00e7li tercih yapmas\u0131na katk\u0131da bulunmal\u0131d\u0131r. Hizmet Sa\u011flay\u0131c\u0131 bir E-Ma\u011faza Do\u011frulama Kurulu\u015funa (E-Ma\u011faza Do\u011frulama Kurulu\u015fu) kay\u0131tl\u0131 de\u011filse, hizmet sa\u011flay\u0131c\u0131n\u0131n ad\u0131 ve herhangi bir tan\u0131mlay\u0131c\u0131 \u00f6zelli\u011fi, hizmet sa\u011flay\u0131c\u0131n\u0131n ileti\u015fim bilgileri de reklamda a\u00e7\u0131k\u00e7a yer almal\u0131d\u0131r. Ayr\u0131ca elektronik reklamda, t\u00fcketiciyi aldatacak veya yan\u0131ltacak herhangi bir yanl\u0131\u015f teklif, beyan, iddia veya aldat\u0131c\u0131 i\u00e7erik ile hizmet sa\u011flay\u0131c\u0131n\u0131n kullanma hakk\u0131na sahip olmad\u0131\u011f\u0131 yanl\u0131\u015f bir logo veya ticari marka ifadesi bulunmamal\u0131d\u0131r.<\/p>\n<p>Elektronik Ticaretin D\u00fczenlenmesi Hakk\u0131nda Kanun&#8217;da oldu\u011fu gibi E-Ticaret Kanunu ve Y\u00f6netmeli\u011fi&#8217;nin 10. maddesinde de t\u00fcketici elektronik ticari ileti almay\u0131 reddetme hakk\u0131na sahiptir. Hizmet Sa\u011flay\u0131c\u0131, bu talebin kendisine ula\u015ft\u0131\u011f\u0131 andan itibaren T\u00fcketiciye elektronik reklam g\u00f6ndermeyi durdurmakla y\u00fck\u00fcml\u00fcd\u00fcr. Ayr\u0131ca E-Ticaret Kanunu ve Y\u00f6netmeli\u011fi&#8217;nde elektronik reklamlara ili\u015fkin ki\u015fisel verilerin korunmas\u0131na dair bir d\u00fczenleme yer almaktad\u0131r. Bu d\u00fczenlemelere ili\u015fkin a\u00e7\u0131klamalar\u0131m\u0131z Ki\u015fisel Verilerin Korunmas\u0131 Kanunu b\u00f6l\u00fcm\u00fcnde yer almaktad\u0131r.<\/p>\n<p>Veri Koruma<\/p>\n<p>E-Ticaret Kanunu&#8217;nda t\u00fcketici verilerinin korunmas\u0131na ili\u015fkin a\u00e7\u0131k bir vurgu bulunmakta olup, E-Ticaret Kanunu hizmet sa\u011flay\u0131c\u0131ya t\u00fcketici verilerinin gizlili\u011fini koruma konusunda yasal bir y\u00fck\u00fcml\u00fcl\u00fck getirmektedir. E-Ticaret Kanunu&#8217;nun 5. maddesinde belirtildi\u011fi \u00fczere Y\u00f6netmelikte ki\u015fisel veri olarak kabul edilen bilgiler say\u0131lm\u0131\u015ft\u0131r [3]. Buna g\u00f6re Y\u00f6netmeli\u011fin 5. maddesinde isim, kimlik bilgileri, adres, telefon numaras\u0131, ki\u015fisel malvarl\u0131\u011f\u0131, hesap ve banka kart\u0131 numaralar\u0131, hareketsiz ve hareketli resimler gibi T\u00fcketicinin kimli\u011fine ili\u015fkin belirli bilgileri i\u00e7eren bilgiler ki\u015fisel veri olarak tan\u0131mlanm\u0131\u015ft\u0131r. Buna g\u00f6re Hizmet Sa\u011flay\u0131c\u0131, E-Ticaret Kanunu uyar\u0131nca, elektronik i\u015flemin niteli\u011finin gerektirdi\u011fi s\u00fcre hari\u00e7 olmak \u00fczere, farkl\u0131 zamanlarda taraflarca kararla\u015ft\u0131r\u0131lmad\u0131k\u00e7a, y\u00fck\u00fcml\u00fcl\u00fcklerini yerine getirme amac\u0131 d\u0131\u015f\u0131nda T\u00fcketicinin ki\u015fisel verilerini ve elektronik haberle\u015fmelerini saklayamayacakt\u0131r. Ayr\u0131ca, saklama s\u00fcresi boyunca bu ki\u015fisel verilerin ve elektronik ileti\u015fimlerin gizlili\u011finin korunmas\u0131 ve s\u00fcrd\u00fcr\u00fclmesi i\u00e7in gerekli tedbirleri alacakt\u0131r. Ayr\u0131ca Hizmet Sa\u011flay\u0131c\u0131lar, T\u00fcketicinin ki\u015fisel verilerini veya elektronik haberle\u015fmelerini yetkisiz ama\u00e7larla kullanmayacak ve T\u00fcketici bu t\u00fcr bir if\u015faya izin vermedik\u00e7e veya kanunen gerekli olmad\u0131k\u00e7a, bunlar\u0131 \u00fccretsiz olarak veya kendi \u00e7\u0131karlar\u0131 i\u00e7in ba\u015fka kurulu\u015flara if\u015fa etmeyecektir. AB ve T\u00fcrk mevzuat\u0131nda da benzer \u015fekilde ki\u015fisel veri i\u015fleme \u015fartlar\u0131 ki\u015fisel veri mevzuat\u0131nda tan\u0131mlanm\u0131\u015f olup, herhangi bir veri i\u015fleme \u015fart\u0131 kanunla \u00f6zel olarak d\u00fczenlenmemi\u015ftir. T\u00fcrk Elektronik Ticaret d\u00fczenlemelerinde e-ticaret s\u0131ras\u0131nda elde edilecek ki\u015fisel veriler ve ki\u015fisel veri i\u015fleme \u015fartlar\u0131 say\u0131lmam\u0131\u015f olup, veriler ancak Ki\u015fisel Verilerin Korunmas\u0131 Kanunu&#8217;nda say\u0131lan hallerde i\u015flenebilmektedir.<\/p>\n<p>Ayr\u0131ca, Elektronik Ticaretin D\u00fczenlenmesi Hakk\u0131nda Kanun&#8217;da, E-Ticaret Kanunu&#8217;nun 5. maddesinde oldu\u011fu gibi t\u00fcketicinin ki\u015fisel verilerinin saklanma s\u00fcresi belirtilmemi\u015ftir.<\/p>\n<p>Suudi Arabistan E-Ticaret Kanunu&#8217;nda Hizmet Sa\u011flay\u0131c\u0131, T\u00fcketicinin ki\u015fisel verilerinin korunmas\u0131ndan birlikte \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015ftiraklerinden veya ba\u011fl\u0131 kurulu\u015flar\u0131ndan da sorumludur. T\u00fcrkiye&#8217;deki Veri Koruma Kanunu&#8217;nu inceledi\u011fimizde ise Veri Koruma Kanunu&#8217;nun 12. maddesinde ki\u015fisel verilerin g\u00fcvenli\u011finden veri sorumlusu ve veri i\u015fleyenin m\u00fcteselsilen sorumlu olaca\u011f\u0131 belirtilmi\u015ftir. Ancak Suudi Arabistan&#8217;da halihaz\u0131rda y\u00fcr\u00fcrl\u00fckte olan bir Veri Koruma Kanunu d\u00fczenlemesi bulunmad\u0131\u011f\u0131ndan, ilgili Y\u00f6netmelikten e-ticaret i\u015flemleri s\u0131ras\u0131nda ki\u015fisel verilerin i\u015flenmesinden kaynaklanan bir veri g\u00fcvenli\u011fi ihlalinde sorumlulu\u011fun veri sorumlusu olarak Hizmet Sa\u011flay\u0131c\u0131da olaca\u011f\u0131 sonucuna var\u0131lmaktad\u0131rAyr\u0131ca T\u00fcrk e-ticaret mevzuat\u0131nda ve ilgili Suudi Arabistan mevzuat\u0131nda hizmet sa\u011flay\u0131c\u0131, t\u00fcketicinin ki\u015fisel verilerini \u00fc\u00e7\u00fcnc\u00fc ki\u015filere iletemez veya ba\u015fka ama\u00e7larla kullanamaz.<\/p>\n<p>\u0130hlale ili\u015fkin olarak, T\u00fcrkiye ve Avrupa Birli\u011fi mevzuat\u0131ndan farkl\u0131 olarak, ihlal bildirimi bir Veri Koruma Otoritesine de\u011fil, ilgili Bakanl\u0131\u011fa yap\u0131lmaktad\u0131r. AB ve T\u00fcrk mevzuat\u0131 ile Suudi Arabistan mevzuat\u0131 t\u00fcketiciye yani veri sahibine bildirim a\u00e7\u0131s\u0131ndan ayn\u0131d\u0131r. Kanun ayr\u0131ca t\u00fcketicilerin kendilerine sunulan hizmetler ve t\u00fckettikleri \u00fcr\u00fcnler hakk\u0131nda kapsaml\u0131 ve do\u011fru bilgiye sahip olma hakk\u0131n\u0131 da g\u00fcvence alt\u0131na almaktad\u0131r. \u00dcr\u00fcn hakk\u0131nda verilen temel bilgiler, \u00fcr\u00fcn\u00fcn kayna\u011f\u0131n\u0131, fiyat\u0131n\u0131, niteli\u011fini, temel \u00f6zelliklerini ve kanunun y\u00fcr\u00fctme y\u00f6netmelikleri ile belirlenen di\u011fer bilgileri i\u00e7ermelidir.<\/p>\n<p>Temel t\u00fcketici haklar\u0131 a\u015fa\u011f\u0131daki gibidir:<\/p>\n<p>\u00dcr\u00fcnlerin normal kullan\u0131m\u0131 i\u00e7in sa\u011fl\u0131k ve g\u00fcvenlik hakk\u0131<br \/>\nT\u00fcketicinin sat\u0131n ald\u0131\u011f\u0131, kulland\u0131\u011f\u0131 veya ald\u0131\u011f\u0131 hizmetler veya \u00fcr\u00fcnler hakk\u0131nda t\u00fcm do\u011fru bilgi ve verileri edinme hakk\u0131<br \/>\nTopluluk gelenek ve g\u00f6reneklerine sayg\u0131 g\u00f6sterilmesini sa\u011flama hakk\u0131<br \/>\n\u00dcr\u00fcnlerin sat\u0131n al\u0131nmas\u0131, kullan\u0131lmas\u0131 veya teslim al\u0131nmas\u0131 sonucunda t\u00fcketiciye veya paras\u0131na y\u00f6nelik zararlar i\u00e7in adil tazminat alma hakk\u0131<br \/>\nSat\u0131n alma i\u015fleminden sonraki 30 g\u00fcn i\u00e7inde hatal\u0131 herhangi bir \u00fcr\u00fcn\u00fc tam para iadesi veya de\u011fi\u015ftirme i\u00e7in iade etme hakk\u0131[12]<br \/>\nHerhangi bir \u00fcr\u00fcn\u00fc 14 g\u00fcn i\u00e7inde sebepsiz olarak de\u011fi\u015ftirme veya tam para iadesi i\u00e7in iade etme hakk\u0131[13]<br \/>\nTedarik\u00e7inin Y\u00fck\u00fcml\u00fcl\u00fckleri<\/p>\n<p>Kanun \u00e7ok say\u0131da y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc ele ald\u0131\u011f\u0131ndan, a\u015fa\u011f\u0131da sadece \u00f6nemli olanlar\u0131 inceleyece\u011fiz.<\/p>\n<p>Y\u00fck\u00fcml\u00fcl\u00fcklerin A\u00e7\u0131klanmas\u0131<\/p>\n<p>Tedarik\u00e7i, bir \u00fcr\u00fcnle ilgili t\u00fcm \u00f6nemli veri ve bilgileri, \u00f6zellikle kayna\u011f\u0131, fiyat\u0131 (vergi detaylar\u0131 veya di\u011fer mali y\u00fckler dahil), teknik \u00f6zellikleri ve \u00f6zellikleri, temel \u00f6zellikleri, nerede ve ne zaman sunuldu\u011fu, M\u0131s\u0131r Standartlar\u0131 \u015eartnamesinde say\u0131lan veriler ve yay\u0131nland\u0131\u011f\u0131nda y\u00fcr\u00fctme y\u00f6netmeli\u011finin gerektirece\u011fi di\u011fer verileri a\u00e7\u0131k\u00e7a if\u015fa etme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne sahiptir.[14]Ayr\u0131ca, \u00fcr\u00fcn bilgileri, tedarik\u00e7inin ba\u015fta adresi, ileti\u015fim bilgileri ve varsa ticari markas\u0131 olmak \u00fczere tan\u0131mlanabilir bilgilerini de Arap\u00e7a olarak i\u00e7ermelidir.<\/p>\n<p>Tedarik\u00e7iler ayr\u0131ca, reklamlar, veriler, bilgiler, belgeler, faturalar ve makbuzlar da dahil olmak \u00fczere t\u00fcketiciye y\u00f6nelik t\u00fcm mesajlar\u0131n Arap\u00e7a veya Tedarik\u00e7inin takdirine ba\u011fl\u0131 olarak ba\u015fka dillerde yaz\u0131lmas\u0131n\u0131 sa\u011flamakla y\u00fck\u00fcml\u00fcd\u00fcr. Bu veriler a\u00e7\u0131k\u00e7a belirtilmeli ve t\u00fcketici taraf\u0131ndan kolayca okunup anla\u015f\u0131labilmelidir.<\/p>\n<p>Garanti Y\u00fck\u00fcml\u00fcl\u00fckleri<\/p>\n<p>Bu Kanunun 3. Maddesine g\u00f6re, Tedarik\u00e7i sa\u011fl\u0131k ve g\u00fcvenlik ve kalite kurallar\u0131na uyacak ve bunlar\u0131 M\u0131s\u0131r Standartlar\u0131 \u015eartnamelerine veya M\u0131s\u0131r&#8217;da onaylanan uluslararas\u0131 standart \u015fartnamelerine uygun olarak garanti edecektir.<\/p>\n<p>Cezalar<\/p>\n<p>Yeni yasa, d\u00fczenlemeleri ihlal eden \u015firketlere veya t\u00fcccarlara kar\u015f\u0131 kat\u0131 cezalar getirerek, herhangi bir \u00fcr\u00fcn\u00fcn veya pazar\u0131n tekelini ve bu Kanunun 9. Maddesi kapsam\u0131nda herhangi bir bi\u00e7imde yanl\u0131\u015f ve\/veya yan\u0131lt\u0131c\u0131 reklam veya davran\u0131\u015f\u0131 ihlal ba\u015f\u0131na iki milyon EGP&#8217;ye kadar para cezas\u0131 ile su\u00e7 saymaktad\u0131r.<\/p>\n<p>\u0130\u015fletmelerin (yukar\u0131da da belirtti\u011fimiz gibi) m\u00fc\u015fteriyi a\u00e7\u0131k bir \u015fekilde bilgilendirme y\u00fck\u00fcml\u00fcl\u00fcklerini yerine getirmemeleri durumunda, i\u015fletmeler aksi takdirde 10.000 EGP ile 50.000 EGP aras\u0131nda bir para cezas\u0131 ile kar\u015f\u0131 kar\u015f\u0131ya kalacakt\u0131r.<\/p>\n<p>Hatal\u0131 \u00fcr\u00fcnlerin neden oldu\u011fu fiziksel zarar veya \u00f6l\u00fcm, tedarik\u00e7inin hapis cezas\u0131na \u00e7arpt\u0131r\u0131laca\u011f\u0131 a\u011f\u0131r cezalard\u0131r[15].<\/p>\n<p>M\u0131s\u0131r&#8217;da Veri Koruma Kanunu<\/p>\n<p>M\u0131s\u0131r&#8217;\u0131n Ki\u015fisel Verilerin Korunmas\u0131 Kanunu 13 Temmuz 2020 tarihinde kabul edilmi\u015f ve 15 Temmuz 2020 tarihinde yay\u0131mlanm\u0131\u015ft\u0131r. Kanun 15 Ekim 2020 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe girecek olup, Y\u00fcr\u00fctme Y\u00f6netmeliklerinin ise 14 Nisan 2021 tarihine kadar \u00e7\u0131kmas\u0131 beklenmektedir. Ki\u015fisel Verilerin Korunmas\u0131 Kanunu, \u00e7e\u015fitli uyum gerekliliklerinin yan\u0131 s\u0131ra baz\u0131 \u00f6nemli cezai yapt\u0131r\u0131mlar da getirmektedir.<\/p>\n<p>Y\u00f6netmelik, yeni d\u00fczenleyicinin rol\u00fc ve yeni Kanunu nas\u0131l uygulayaca\u011f\u0131 konusunda daha fazla ayr\u0131nt\u0131 sa\u011flayacakt\u0131r. \u015eirketler, Y\u00f6netmeli\u011fin yay\u0131nland\u0131\u011f\u0131 tarihten itibaren Kanuna uyum sa\u011flamak i\u00e7in 12 ayl\u0131k bir ek s\u00fcreye sahip olacakt\u0131r.[16] M\u0131s\u0131r&#8217;daki yeni Veri Koruma Kanunu, T\u00fcrkiye ve AB&#8217;deki Y\u00f6netmeliklerin tan\u0131mlar\u0131 ve kapsamlar\u0131 ile benzerlik g\u00f6stermektedir. GDPR ve T\u00fcrkiye&#8217;deki Veri Koruma Kanunu gibi, M\u0131s\u0131r&#8217;daki Y\u00f6netmelikler kapsam\u0131nda da ilgili ki\u015filerin \u00e7e\u015fitli temel haklar\u0131 bulunmaktad\u0131r. GDPR&#8217;den farkl\u0131 olarak, Kanunun 1. Maddesi yaln\u0131zca elektronik ortamda i\u015flenen ki\u015fisel veriler i\u00e7in ge\u00e7erli olup, m\u00fcnhas\u0131ran fiziksel formatta tutulan veriler d\u00fczenlenmemi\u015ftir.<\/p>\n<p>Veri \u0130\u015fleme<\/p>\n<p>Ki\u015fisel Verilerin Korunmas\u0131 Kanunu, veri sahibinin r\u0131zas\u0131 d\u0131\u015f\u0131nda veya yasalar\u0131n izin verdi\u011fi haller d\u0131\u015f\u0131nda ki\u015fisel verilerin i\u015flenmesini yasaklamaktad\u0131r. \u0130\u015flemenin yasal ve \u015feffaf olmas\u0131 ve toplanan ki\u015fisel verilerin \u00f6ng\u00f6r\u00fclen amac\u0131 yerine getirmek i\u00e7in gerekli olandan daha uzun s\u00fcre saklanmamas\u0131 gerekmektedir.<\/p>\n<p>GDPR&#8217;nin aksine, \u015feffafl\u0131k y\u00fck\u00fcml\u00fcl\u00fcklerinin bir par\u00e7as\u0131 olarak, M\u0131s\u0131r&#8217;daki veri denetleyicileri ki\u015fisel verileri i\u015flemeden \u00f6nce bir gizlilik bildirimi a\u00e7\u0131klamak zorunda de\u011fildir. Bununla birlikte, Madde 4 uyar\u0131nca silme mekanizmas\u0131n\u0131, bu t\u00fcr verilerin saklama s\u00fcresini ve benzerlerini a\u00e7\u0131klayan bir kay\u0131t tutmalar\u0131 gerekmektedir[17].<\/p>\n<p>S\u0131n\u0131r \u00d6tesi Transfer<\/p>\n<p>Belirli istisnalara tabi olarak, bir \u015firket D\u00fczenleyici Kurumdan bir verinin s\u0131n\u0131r \u00f6tesi aktar\u0131m\u0131 i\u00e7in lisans almal\u0131 ve ki\u015fisel verileri yaln\u0131zca Kanun kapsam\u0131nda ki\u015fisel verilere M\u0131s\u0131r ile ayn\u0131 d\u00fczeyde koruma sa\u011flayan bir \u00fclkeye aktarmal\u0131d\u0131r (Madde 14).<\/p>\n<p>Ki\u015fisel verilere M\u0131s\u0131r ile ayn\u0131 d\u00fczeyde koruma sa\u011flamayan bir \u00fclkeye veri aktar\u0131m\u0131, M\u0131s\u0131r Veri Koruma Merkezi&#8217;nin (hen\u00fcz kurulmam\u0131\u015ft\u0131r) onay\u0131 ile ve sa\u011flanan koruma d\u00fczeyinin Ki\u015fisel Verilerin Korunmas\u0131 Kanunu uyar\u0131nca M\u0131s\u0131r&#8217;da sa\u011flanandan daha az olmamas\u0131 halinde ger\u00e7ekle\u015ftirilecektir.<\/p>\n<p>Madde 15, veri sahibinin a\u00e7\u0131k r\u0131zas\u0131n\u0131n al\u0131nmas\u0131 gibi Madde 14 k\u0131s\u0131tlamas\u0131na ili\u015fkin bir dizi istisnay\u0131 d\u00fczenlemektedir.<\/p>\n<p>Veri Koruma G\u00f6revlileri<\/p>\n<p>M\u0131s\u0131r&#8217;da ki\u015fisel veri i\u015fleyen yabanc\u0131 \u015firketler M\u0131s\u0131r&#8217;da bir temsilci atamakla y\u00fck\u00fcml\u00fcd\u00fcr. M\u0131s\u0131r d\u0131\u015f\u0131ndaki veri kontrol\u00f6rleri i\u00e7in, M\u0131s\u0131rl\u0131 veri sahipleri ve D\u00fczenleyici i\u00e7in bir irtibat noktas\u0131 olarak yerel bir temsilci Veri Koruma G\u00f6revlisi (DPO) atanmal\u0131d\u0131r.<\/p>\n<p>Bildirim Gereklilikleri<\/p>\n<p>Bir g\u00fcvenlik ihlali durumunda, GDPR&#8217;den farkl\u0131 olarak, hem kontrol\u00f6rler hem de i\u015fleyiciler olay\u0131 72 saat i\u00e7inde D\u00fczenleyiciye bildirmekle y\u00fck\u00fcml\u00fcd\u00fcr. Ulusal g\u00fcvenli\u011fi etkileyen bir ihlal durumunda, \u015firketler olay\u0131 derhal D\u00fczenleyiciye ve \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131 ve Genel \u0130stihbarat M\u00fcd\u00fcrl\u00fc\u011f\u00fc de dahil olmak \u00fczere Milli G\u00fcvenlik makamlar\u0131na bildirmelidir[18].<\/p>\n<p>Cezalar<\/p>\n<p>Ki\u015fisel Verilerin Korunmas\u0131 Kanunu, para ve hapis cezalar\u0131 da dahil olmak \u00fczere bir dizi cezai yapt\u0131r\u0131m i\u00e7eren \u00e7e\u015fitli su\u00e7lar \u00f6ng\u00f6rmektedir. Bunlar \u015funlar\u0131 i\u00e7erir:<\/p>\n<p>Veri sahibinin r\u0131zas\u0131 d\u0131\u015f\u0131nda veya yasalar\u0131n izin verdi\u011fi haller d\u0131\u015f\u0131nda ki\u015fisel verilerin Korunmas\u0131 Kanunu&#8217;na uygun olmayan \u015fekilde i\u015flenmesi ve aktar\u0131lmas\u0131;<br \/>\nVeri sahibinin Ki\u015fisel Verilerin Korunmas\u0131 Kanunu uyar\u0131nca kendisine tan\u0131nan haklar\u0131 kullanmas\u0131n\u0131n engellenmesi;<br \/>\nVeri sorumlusu veya veri i\u015fleyenin belirli y\u00fck\u00fcml\u00fcl\u00fcklere uymamas\u0131 ve bildirim\/raporlama
